The time it takes to get your settlement check depends on which insurance company you’re dealing with, whether they’ve used an independent adjuster, what time of year it is, and where you live. Trying to close your claim with an independent adjuster in December, may cause the longest wait. That said, the delay should only be around two weeks.
If you’ve hired a lawyer, it’s common practice for the settlement check and a release form to be sent in one package to the lawyer’s office. The funds are then processed through the trust account and a cheque is cut to the client for the remainder after fees in exchange for a signed release form.
If you have settled a case on your own, as opposed to hiring a lawyer, it’s likely that a release has been sent to you to sign and return to the insurance company or their independent adjuster before the settlement cheque is sent to the injury victim. Once you return the release to the insurance adjuster, the settlement cheque is sent to you. If you have not received your settlement funds within two weeks or at least heard from the insurance company regarding the status of the closing paperwork, you should contact the insurance adjuster, as it may be that your contact person is on vacation, or that there’s some issue with the address on file.
