Halifax ATV Accident Lawyers
All-terrain vehicles, commonly known as ATVs are commonly used to provide a thrilling way to explore Nova Scotia’s beautiful landscapes. However, like any other motorized vehicle, ATVs come with inherent risks, and unfortunately, accidents do happen and NOVA Injury Law is here to help.
The consequences of ATV accidents can be severe, ranging from minor injuries to permanent disabilities and death. In addition to the physical consequences, ATV accidents can also have an emotional and financial impact on the affected individual and their families.
The Off-Highway Vehicles Act
In Nova Scotia, the Off-Highway Vehicles Act regulates all off-road vehicles that are not registered under the Motor Vehicle Act. This legislation sets out various requirements for off-road vehicles, including minimum age requirements, where you can ride, insurance, and other safety obligations. Under the Off-Highway Vehicles Act, riders of off-road vehicles, including ATVs, must carry with them a valid motor vehicle liability policy that covers third-party liability, accidental benefits, and insurance for underinsured or non-insured drivers. Each off-highway vehicle must have a minimum of $500,000 in liability insurance to protect them financially in the event they are sued for injuring another person or damaging property.
If you are only driving your ATV or other off-highway vehicle on your own property, you are not required to obtain third-party liability coverage, although it may still be a good idea. Not all insurance companies provide coverage for off-highway vehicles, so you may need to contact a broker outside of the one you typically use. There may be specific rules for children under the age of sixteen who drive off-highway vehicles. If this is the case, be sure to stay informed of the requirements (and potential consequences) of letting a non-licensed adult or child under sixteen use an off-highway vehicle.
How Does Liability Work in an ATV Accident?
If someone else is responsible for an accident, you have the right to seek compensation. Like any accident, determining who is at fault can be a complicated process. In ATV accidents, liability may fall on various parties, such as the driver, owner, manufacturer, or those responsible for trail maintenance. Negligence may be found where there has been a failure to obey speed limits, failure to have proper safety equipment, or failure to obey the rules of the Off-Highway Vehicles Act. At NOVA Injury Law, our goal is to identify all potentially liable parties to secure the compensation you are entitled to receive.
How can NOVA Injury Law Help You?
The vast majority of individuals who use ATVs do so on specific routes and trails that are designed for ATV use. These trails often involve intersections where serious accidents can occur if one or both parties fail to yield. However, ATV accidents can occur in a variety of ways, some of the most common include driving under the influence of drugs or alcohol, distracted driving, poorly maintained trails, and mechanical issues.
At NOVA Injury Law, we understand that ATV accident claims can be complex. That’s why our compassionate team of ATV accident lawyers are prepared to help guide you through every aspect of your claim. Our goal is to ensure you receive full compensation for your injuries and losses.
