Sample Negotiation Confirmation Letter Used In Injury Settlement Negotiations

Whenever you’re been told anything important about your injury claim it is important to have a paper trail. While e-mail may be used during the course of your claim, key conversations may still occur over the phone. Be sure to create a paper trial for important phone conversations using a negotiation confirmation letter.

It is important to make a paper trial to protect your injury claim. The negotiation confirmation letter will help protect you against a situation where there is a dispute about what was said later on during the course of negotiations. Be sure to write down the information as soon as possible after the conversation. It’s important to record times and details while the information is still fresh in your mind. The letter does not have to be overly formal or official. Its purpose is simply to document what occurred. Be sure to keep a copy of the letter in a file dedicated to the injury claim.

To help you with this task, we have provided a sample of the letter that can be modified as needed to capture the important information. You can follow the format provided for nearly all important conversations.

Dear Mr. MacDonald:

This letter will confirm our telephone discussion of January 11, 20xx in which you offered a settlement of $xxxx to settle the injury claim for the above references matter.

-Option 1 (record offer): I will be in contact with you once I have had the opportunity to consider the offer.
-Option 2 (counter offer): I appreciate the offer made to settle this claim. I cannot accept the offer but do provide a counter offer of $xxxxx. I look forward to your reply to this counter offer.

-Option 3 (settlement accepted): I accept the offer above. Please mail the cheque and release to my address [insert address].
