Past lost wagesPast wage loss provides compensation for the income you were unable to earn while you were unable to work due to your injury. Were you working at the time of your accident? Yes No Why weren't you working at the time of the accident? I was in between jobs. I was temporarily off work due to a disability. I was permanently unable to work due to a disability. I was a stay-at-home parent or caregiver. I was retired but intended to return to work part-time or occasionally. I was fully retired with no plans to return to work. Can you briefly describe your occupation, work hours, and income?Have you missed time from work or had to use vacation or sick days due to your injury? Yes No How much time did you miss because you were unable to work?Have you missed time from work to attend treatment appointments? Yes No How many days or hours have you missed from attending appointments?Past wage loss refers to the income you were unable to earn while you were off work due to your injury. Even if you received pay by using sick leave or vacation days, it still counts as a loss, since those days are no longer available for future illness or time off. Courts determine the amount of past wage loss by reviewing your employment and tax records. Your own auto insurance—specifically, Section B coverage—offers limited income replacement of about $250 per week while you’re off work, which is generally not enough. Some individuals may also have short- or long-term disability insurance through their employer or union. These policies typically provide more than Section B, but still fall short of covering your full salary. Any remaining loss must be recovered from the person responsible for your injury.3. Future earning capacity must account for the possibility of promotions, wage increases, or skills and experience that will make you more marketable and thus eligible for a higher salary. This calculation also involves looking at the number of years you have left in the workforce. Housekeeping and home maintenance are services that most individuals perform for themselves on an unpaid basis. The court will compare the chores you could complete before the accident with those you can do after. You can be compensated under this head of damages even if you did not pay someone to help you complete housekeeping chores.6.
